Terms of Service

These terms govern your use of flock ("we", "us", "our"), a queue management product for venues. By signing up, you agree to these terms.

1. The service

flock provides venues with tools to manage guest queues, send WhatsApp notifications, view history, and access analytics. The service is provided "as is" — we work to keep it reliable and improve it continuously, but cannot guarantee uninterrupted operation.

2. Accounts

  • You must be 18 or older to sign up.
  • You're responsible for keeping your login credentials secure.
  • You're responsible for what happens under your account.
  • One account can manage multiple venues. Each venue is billed separately.

3. Subscription and billing

  • flock costs ₹999 per venue per month after a 14-day free trial.
  • Your subscription auto-renews monthly. We charge the payment method on file at the start of each billing cycle.
  • You can cancel anytime from your dashboard. Cancellation takes effect at the end of the current billing cycle.
  • We don't issue refunds for partial months, but you keep access for the time you've paid for.
  • Prices may change. We'll notify you at least 30 days before any price change takes effect.

4. Your data, your guests' data

  • You own your queue data. We act as a processor on your behalf.
  • You're responsible for ensuring you have the right to collect and use the guest data you input into flock.
  • You must comply with applicable privacy and consumer laws when using flock to contact guests.

5. Acceptable use

You agree not to:

  • Use flock to send spam, marketing, or unsolicited messages to guests.
  • Use flock to harass, defraud, or harm any person.
  • Attempt to gain unauthorised access to flock's systems or other users' data.
  • Reverse-engineer, decompile, or attempt to extract source code.
  • Resell, sublicense, or rebrand flock without our written permission.

We reserve the right to suspend or terminate accounts that violate these terms.

6. WhatsApp messages

flock sends WhatsApp messages to guests via Gupshup using approved templates. We rely on WhatsApp's and Meta's policies for delivery — we cannot guarantee every message is delivered, and we are not responsible for delivery failures caused by recipient device issues, WhatsApp restrictions, or network problems.

7. Service availability

We aim for high availability but don't offer a formal SLA on the standard plan. Scheduled maintenance and unexpected downtime may occur. We don't owe credits or refunds for downtime on the standard plan.

8. Intellectual property

flock and its design, code, and branding are our property. You receive a limited, non-transferable licence to use flock as long as your subscription is active. You don't acquire any ownership rights.

9. Termination

  • You can cancel anytime from your dashboard.
  • We can terminate your account for breach of these terms, non-payment, or illegal use.
  • On termination, your data is retained for 30 days, then permanently deleted unless you request earlier deletion.

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claims arising out of or related to flock is limited to the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, incidental, or consequential damages — including lost profits, lost revenue, or loss of business reputation.

11. Changes to these terms

We may update these terms over time. If we make material changes, we'll email you. Continued use of flock after changes take effect means you accept the new terms.

12. Governing law and disputes

These terms are governed by the laws of India. Any disputes will be resolved in the courts of Bengaluru, Karnataka, India.
